Terms & Conditions

Last Updated: 24 January 2025 · Effective Date: 24 January 2025

Please read these Terms and Conditions carefully before using the Pulsarai website or engaging our services. By accessing this website or entering into a service agreement with Pulsarai, you agree to be bound by these terms.

1. Definitions

2. Acceptance of Terms

By accessing this website or engaging our services, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and that you have the legal capacity to enter into binding agreements. If you are acting on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Services Description

Pulsarai provides professional AI consulting and development services including Computer Vision Solutions, Natural Language Understanding Platform development, and AI Integration Architecture engagements. Services are delivered as described in individual service agreements or statements of work signed by both parties.

Service availability is subject to capacity and mutual agreement. We do not operate a walk-in or on-demand service model — engagements begin following a scoping discussion and signed agreement.

4. User Responsibilities

5. Intellectual Property

All website content — including text, design, logos, and structural elements — is the intellectual property of Pulsarai and may not be reproduced or used without written permission.

For client engagements, intellectual property terms (including ownership of deliverables, code, and model artefacts) are defined in individual service agreements. Our default position is that full artefact ownership transfers to the client upon completion and final payment.

Pulsarai retains the right to reference the general nature of completed engagements (without disclosing client identifiers or proprietary information) for marketing purposes, unless the client requests otherwise in writing.

6. Payment Terms

Service fees are denominated in Malaysian Ringgit (MYR) and are as set out in individual service agreements. Standard payment terms are 50% upon project commencement and 50% upon delivery of final deliverables, unless otherwise agreed in writing.

Payments are accepted via bank transfer to Pulsarai's nominated account. Invoices are payable within 14 days of issue. Late payments may result in suspension of active project work.

Where project scope changes are requested by the client, revised fees will be agreed in writing before additional work proceeds. There are no hidden charges beyond the agreed scope.

7. Refunds and Cancellation

Given the professional services nature of our work, refunds are not provided for work already completed and delivered. If a project is cancelled by the client partway through, fees for completed phases are retained and any remaining deposits are refunded at our discretion based on the stage reached.

If Pulsarai is unable to deliver as agreed due to circumstances within our control, we will provide a fair remedy — which may include a partial refund, rework, or scope adjustment as appropriate.

8. Disclaimers

This website and its contents are provided "as is" without representations or warranties of any kind. While we take care to ensure information is accurate, we do not warrant its completeness or suitability for any particular purpose.

AI systems involve inherent uncertainty. Pulsarai does not represent that any model or system will achieve specific results in all circumstances. Performance benchmarks are defined and measured for agreed test conditions and may vary in production environments.

9. Limitation of Liability

To the maximum extent permitted under Malaysian law, Pulsarai's total liability to any client arising from or related to a service engagement shall not exceed the total fees paid by that client for the relevant engagement.

We are not liable for indirect, incidental, or consequential losses including loss of profit, loss of data, or business interruption, even if we have been advised of the possibility of such losses.

10. Confidentiality

Both parties are expected to maintain confidentiality of non-public information shared during the course of an engagement. Specific confidentiality obligations are governed by the mutual non-disclosure agreement signed at the start of each engagement.

11. Termination

Either party may terminate a service engagement by providing 14 days written notice. Upon termination, all outstanding fees for work completed to date become payable.

Pulsarai reserves the right to suspend or terminate access to website services if a user is found to have violated these terms.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or from service engagements shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Before initiating formal proceedings, both parties agree to attempt resolution through good-faith discussion within 30 days of the dispute arising.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the website or services following material changes constitutes acceptance of the revised Terms.
